Terms of Service

Terms of Service

Last Updated: July 30, 2026

OVERVIEW

This website is operated by STOREVIA LIMITED under the store name Sketchora.

Throughout this website, the terms “Sketchora,” “we,” “us,” and “our” refer to STOREVIA LIMITED, where appropriate.

Sketchora offers this website, including the information, products, features, tools, and services available through sketchora.us, to you conditioned upon your acceptance of these Terms of Service and all other policies and notices referenced in them.

By visiting our website, creating an account, submitting information, placing an order, purchasing a product, or otherwise using any part of the website, you agree to be bound by these Terms of Service.

These Terms apply to all users of the website, including browsers, customers, account holders, vendors, merchants, and contributors of content.

Please read these Terms carefully before accessing or using our website. If you do not agree to these Terms, you must not access the website, place an order, or use our services.

These Terms incorporate by reference our:

  • Privacy Policy
  • Shipping & Delivery Policy
  • Return & Refund Policy
  • Contact Us page
  • Any product-specific terms or notices displayed before purchase

If a provision in a product-specific policy directly conflicts with a general provision in these Terms, the more specific provision will govern the relevant issue to the extent permitted by applicable law.

Nothing in these Terms is intended to exclude, restrict, or waive any consumer right or legal remedy that cannot lawfully be excluded, restricted, or waived.

SECTION 1 – ELIGIBILITY AND ONLINE STORE TERMS

By using this website, you represent that:

  • You have reached the age of legal majority in your place of residence; or
  • You are using the website with the permission and supervision of a parent or legal guardian who accepts these Terms on your behalf.

You may not use our website or products for any unlawful, fraudulent, abusive, or unauthorized purpose.

You may not use the website in a manner that violates any law, regulation, intellectual property right, privacy right, contractual obligation, or third-party right applicable to you.

You are responsible for determining whether purchasing, possessing, importing, transporting, storing, or using a particular product is lawful in your location.

A violation of these Terms may result in restriction, suspension, or termination of your access to the website, cancellation of an order, or other action permitted by applicable law.

SECTION 2 – GENERAL CONDITIONS

We reserve the right to refuse or restrict service, cancel an order, limit quantities, or terminate access for lawful reasons, including:

  • Suspected fraud or unauthorized payment activity
  • Incorrect or unverifiable customer information
  • Product unavailability
  • Pricing or listing errors
  • Shipping restrictions
  • Safety concerns
  • Compliance with laws, regulations, court orders, sanctions, or carrier requirements
  • Abuse, harassment, threats, or misuse of our services
  • Violation of these Terms or another store policy
  • Orders that appear intended for unauthorized commercial exploitation or unlawful resale

We will not refuse service on a basis prohibited by applicable law.

You may not reproduce, duplicate, copy, sell, resell, exploit, scrape, or commercially use any portion of the website or its content without our prior written permission, except where such activity is expressly permitted by law.

SECTION 3 – CUSTOMER ACCOUNTS

Certain website features may permit or require you to create a customer account.

You are responsible for:

  • Providing accurate and current account information
  • Maintaining the confidentiality of your login information
  • Restricting access to your account and devices
  • Reviewing activity conducted through your account
  • Promptly notifying us of suspected unauthorized access

You must not create an account using false, misleading, stolen, or unauthorized information.

We may suspend or close an account when we reasonably believe that it has been compromised, used fraudulently, or used in violation of these Terms.

You remain responsible for orders placed through your account to the extent permitted by applicable law, except where the activity resulted from circumstances for which you are not legally responsible.

SECTION 4 – CUSTOMER INFORMATION

You agree to provide complete, current, and accurate information when placing an order, including:

  • Your legal or authorized recipient name
  • Billing address
  • Shipping address
  • Email address
  • Telephone number
  • Payment information
  • Any information reasonably required to process or deliver the order

You are responsible for promptly updating information that changes before an order is processed or shipped.

We are not responsible for delays, failed deliveries, additional carrier fees, or other problems caused by inaccurate or incomplete information supplied by you, except to the extent otherwise required by applicable law.

SECTION 5 – ORDER SUBMISSION AND ACCEPTANCE

Submitting an order constitutes an offer to purchase the selected products subject to these Terms.

An automated order confirmation confirms that we received your order. It does not necessarily mean that:

  • Payment has been finally accepted
  • Product availability has been confirmed
  • The order has been approved
  • A binding sale has been completed
  • The order has been shipped

We may review an order for payment authorization, fraud prevention, product availability, shipping eligibility, pricing accuracy, and compliance purposes.

An order is accepted when we send an express acceptance notice, ship the product, or otherwise confirm acceptance through the website or by email.

We may reject or cancel an order before shipment for a lawful reason.

If we cancel an order after payment has been collected, we will provide an appropriate refund for the canceled portion using the original payment method whenever reasonably possible.

SECTION 6 – PRODUCT AVAILABILITY

Product availability may change without notice.

A product displayed as available may become unavailable because of:

  • Inventory changes
  • Supplier shortages
  • Manufacturing interruptions
  • Damaged inventory
  • Fulfillment errors
  • Shipping restrictions
  • Regulatory restrictions
  • Unusually high demand

If an ordered product becomes unavailable, we may:

  • Cancel and refund the unavailable item
  • Contact you regarding a revised availability date
  • Ask whether you wish to wait
  • Request your approval for a suitable alternative
  • Ship the available portion of the order separately

We will not intentionally substitute a materially different product without your consent.

Minor packaging, label, or manufacturer presentation changes that do not materially change the ordered product may not require prior approval.

SECTION 7 – ORDER LIMITS

We may limit or cancel quantities purchased:

  • Per person
  • Per household
  • Per customer account
  • Per payment method
  • Per billing or shipping address
  • Per promotion
  • Per product

These restrictions may apply to orders placed through the same customer account, payment card, billing address, shipping address, telephone number, device, or other reasonably related information.

Where an order limit applies, we may contact you or cancel the affected quantity and provide an appropriate refund.

SECTION 8 – PRICES AND CURRENCY

Unless otherwise stated, prices displayed on sketchora.us are shown in United States dollars.

Prices may change without notice before an order is accepted.

The price charged for a product will generally be the price displayed during checkout and confirmed in the order summary, subject to correction of an obvious or genuine pricing error.

Prices may not include:

  • Shipping charges
  • Sales tax
  • Value-added tax
  • Import duties
  • Customs charges
  • Brokerage fees
  • Other government or carrier-imposed charges

Any additional charge collected by Sketchora will be displayed before you submit payment whenever required by applicable law.

For international transactions, your bank or payment provider may apply currency conversion rates, foreign transaction fees, or other charges that are not controlled by Sketchora.

SECTION 9 – PRICING AND LISTING ERRORS

Despite reasonable efforts, a product may occasionally be listed with an incorrect:

  • Price
  • Discount
  • Description
  • Image
  • Specification
  • Quantity
  • Shipping estimate
  • Availability status
  • Product variation

We reserve the right to correct an error before or after an order is submitted.

If an error materially affects an unshipped order, we may:

  • Contact you for confirmation
  • Offer the correct information or price
  • Cancel the affected item
  • Issue a refund for the affected item

We will not increase the amount charged for an existing order without your authorization.

If an order has already been shipped, the appropriate resolution will depend on the circumstances, applicable law, and our relevant store policies.

SECTION 10 – PAYMENT

You agree to provide a valid payment method that you are legally authorized to use.

By submitting payment information, you authorize the applicable payment provider to charge:

  • The product price
  • Shipping charges
  • Applicable taxes
  • Other charges clearly disclosed and accepted during checkout

Payments may be processed by independent third-party payment providers.

Sketchora may not directly receive or store complete payment card information when payment is processed through an external provider.

Payment authorization may be refused, delayed, reversed, or canceled by a bank, card issuer, payment processor, fraud-prevention provider, or other financial institution.

We may request additional verification when reasonably necessary to confirm:

  • The identity of the purchaser
  • Authorization to use the payment method
  • Billing information
  • Shipping information
  • The legitimacy of the transaction

Failure to provide requested verification may result in delay or cancellation.

SECTION 11 – TAXES, DUTIES, AND IMPORT CHARGES

Customers are responsible for applicable taxes, duties, customs charges, brokerage fees, and import costs unless such amounts are expressly included and collected during checkout.

International shipments may be inspected or assessed by customs or another government authority.

Sketchora does not control charges imposed directly by:

  • Customs authorities
  • Postal services
  • Shipping carriers
  • Brokers
  • Banks
  • Payment providers
  • Foreign governments

Failure to pay required import charges or complete required customs procedures may result in delay, return, abandonment, or destruction of the shipment.

Related refunds and deductions are governed by our Shipping & Delivery Policy and Return & Refund Policy.

SECTION 12 – PRODUCT INFORMATION

We make reasonable efforts to present product information accurately.

Product information may be provided by:

  • Manufacturers
  • Suppliers
  • Distributors
  • Fulfillment providers
  • Other authorized product sources

Specifications, packaging, ingredients, materials, colors, measurements, and included components may occasionally change.

Before purchasing, you should review:

  • Product descriptions
  • Dimensions and quantities
  • Material information
  • Age recommendations
  • Warning labels
  • Safety instructions
  • Compatibility information
  • Usage restrictions
  • Included and excluded components

Contact us before purchasing when a particular feature is essential to your intended use.

SECTION 13 – PRODUCT IMAGES AND COLORS

We make reasonable efforts to display product images and colors accurately.

However, the appearance of a product may vary because of:

  • Screen settings
  • Device calibration
  • Lighting conditions
  • Photography
  • Image compression
  • Manufacturing batches
  • Natural material variation
  • Manufacturer packaging updates

We do not guarantee that your device will display every color or texture with complete accuracy.

This section does not limit your rights when a product is materially different from its description or from what was ordered.

SECTION 14 – ART MATERIAL SAFETY

Art materials may contain substances that require careful handling, ventilation, protective equipment, restricted storage, or adult supervision.

Before opening or using a product, you must read and follow all:

  • Product labels
  • Warning statements
  • Age restrictions
  • Manufacturer instructions
  • Safety data
  • Ventilation requirements
  • Storage instructions
  • Disposal instructions
  • Emergency directions

Do not use an art material for a purpose that is inconsistent with its labeling or manufacturer instructions.

Depending on the product, appropriate precautions may include:

  • Working in a well-ventilated area
  • Wearing gloves, eye protection, or protective clothing
  • Avoiding inhalation, ingestion, or prolonged skin contact
  • Keeping the product away from heat, flames, sparks, and ignition sources
  • Keeping the product out of the reach of children and animals
  • Washing hands after use
  • Avoiding use near food, beverages, cookware, or food-contact surfaces
  • Safely sealing and storing the product after use
  • Following local disposal requirements

A product’s availability on Sketchora does not mean it is suitable for every age, environment, technique, or intended use.

Nothing in these Terms replaces the product’s legally required warnings or the manufacturer’s safety instructions.

SECTION 15 – PRODUCTS USED BY CHILDREN

Not every art supply is intended or suitable for children.

A product should not be treated as a children’s product merely because it is colorful, commonly used for crafts, or displayed near other art supplies.

Parents, guardians, teachers, and supervisors are responsible for:

  • Reviewing the product label
  • Confirming the applicable age recommendation
  • Providing appropriate supervision
  • Preventing access to unsuitable materials
  • Ensuring safe storage and disposal

Products containing sharp components, small parts, solvents, aerosols, hot tools, chemicals, resins, cutting tools, or other potential hazards may require adult use or close adult supervision.

Do not allow children to use a product when its label, packaging, or instructions indicate that it is not intended for them.

SECTION 16 – ALLERGIES AND SENSITIVITIES

Certain art products may contain ingredients or materials capable of causing allergic reactions, irritation, staining, or sensitivity.

Customers with known allergies, asthma, chemical sensitivities, skin conditions, or other relevant health concerns should review available ingredient and safety information before use.

Discontinue use if a reaction occurs and seek appropriate medical assistance when necessary.

Sketchora does not provide medical, toxicological, or occupational health advice.

Questions about the safety of a particular product should be directed to an appropriately qualified professional or the product manufacturer.

SECTION 17 – PRODUCT USE AND MISUSE

You are responsible for using products:

  • Lawfully
  • Safely
  • For their intended purpose
  • In accordance with all warnings and instructions
  • With appropriate supervision
  • With appropriate protective equipment
  • In an appropriate environment

Sketchora is not responsible for loss or damage caused solely by misuse, improper storage, unauthorized modification, mixing incompatible materials, ignoring warnings, or using a product for an unintended purpose, except to the extent that responsibility cannot lawfully be excluded.

This section does not excuse a defective product or eliminate any responsibility imposed on Sketchora by applicable law.

SECTION 18 – TOOLS, BLADES, SHARP ITEMS, AND HEATED EQUIPMENT

Some products may include:

  • Craft knives
  • Cutting tools
  • Blades
  • Needles
  • Sculpting tools
  • Hot tools
  • Heating elements
  • Electrical equipment
  • Small components

Such products must be handled carefully and stored securely.

Age restrictions may apply depending on the product and destination.

We may cancel or restrict an order when sale or shipment would violate an applicable law, carrier requirement, or product restriction.

SECTION 19 – PRODUCT RECALLS AND SAFETY NOTICES

If you receive a product recall, corrective action, or safety notice relating to a product purchased from Sketchora, follow the instructions in that notice promptly.

Depending on the circumstances, you may be instructed to:

  • Stop using the product
  • Keep the product away from children
  • Disconnect or isolate the product
  • Return the product
  • Dispose of the product
  • Contact the manufacturer
  • Contact Sketchora

Do not continue using a recalled product contrary to an official safety instruction.

Nothing in this section limits any rights or remedies available under applicable product safety law.

SECTION 20 – SHIPPING AND DELIVERY

Orders are processed and delivered according to our Shipping & Delivery Policy.

Processing and delivery dates are estimates unless expressly identified as guaranteed.

If we cannot ship an order within the promised or legally applicable period, we may provide:

  • Notice of the delay
  • A revised shipping estimate
  • An opportunity to consent to the delay
  • An opportunity to cancel
  • A refund for unshipped merchandise

The options provided will depend on the circumstances and applicable law.

Shipping delays, customs matters, incorrect addresses, carrier investigations, lost packages, delivered-package claims, and international charges are addressed in greater detail in our Shipping & Delivery Policy.

SECTION 21 – RETURNS, REFUNDS, AND EXCHANGES

Returns, refunds, exchanges, cancellations, damaged-item claims, and defective-product claims are governed by our Return & Refund Policy.

Submitting a request does not automatically guarantee approval.

Do not send a product to our registered business address or any other location unless our customer support team has provided written authorization and confirmed the appropriate return address.

Our registered business address is not automatically a product return facility.

Nothing in our Return & Refund Policy limits consumer remedies that cannot lawfully be limited.

SECTION 22 – PROMOTIONS AND DISCOUNTS

Promotions, discount codes, free gifts, and special offers may be subject to separate terms.

Unless otherwise stated:

  • Promotions cannot be combined
  • Discounts cannot be exchanged for cash
  • Discounts cannot be applied retroactively
  • Offers may be limited by product, customer, location, or time
  • Promotional quantities may be limited
  • A promotion may be modified or ended before an order is placed

We may cancel a promotion affected by fraud, technical error, unauthorized distribution, or misuse.

Orders already accepted will be handled according to the terms applicable when they were placed, subject to correction of genuine errors and applicable law.

SECTION 23 – GIFT CARDS AND STORE CREDIT

If Sketchora offers gift cards or store credit, additional terms may apply.

Unless prohibited by law:

  • Gift cards and store credit are not redeemable for cash
  • They may not be resold without authorization
  • They may not be used to purchase other gift cards
  • Lost or stolen codes may not be replaceable without sufficient proof
  • Fraudulent use may result in suspension

Expiration dates and fees, if any, will be disclosed and applied only where permitted by applicable law.

SECTION 24 – INTELLECTUAL PROPERTY

The website and its content may include:

  • Text
  • Logos
  • Graphics
  • Photographs
  • Product arrangements
  • Page designs
  • Icons
  • Videos
  • Software
  • Source code
  • Databases
  • Brand elements

Such content may be owned by STOREVIA LIMITED, its licensors, manufacturers, suppliers, or other rights holders.

You may access and use the website for lawful personal shopping and informational purposes.

You may not, without authorization:

  • Copy or republish substantial website content
  • Remove copyright or trademark notices
  • Use our branding to impersonate Sketchora
  • Create a misleading association with Sketchora
  • Scrape or harvest protected content
  • Sell or commercially exploit website content
  • Reverse engineer website software except where law expressly permits it

No right, title, or interest in the website or its content is transferred to you merely because you access the website or purchase a product.

SECTION 25 – TRADEMARKS AND THIRD-PARTY BRANDS

Sketchora names, logos, graphics, slogans, and store branding may be protected by trademark and unfair competition laws.

Product names, brand names, logos, and trademarks belonging to manufacturers or other third parties remain the property of their respective owners.

The display of a third-party brand does not necessarily mean that the brand sponsors, endorses, or is affiliated with Sketchora beyond the lawful sale or description of its products.

You may not use any brand displayed on the website in a manner that creates confusion about source, sponsorship, authorization, or affiliation.

SECTION 26 – USER REVIEWS AND SUBMISSIONS

You may be able to submit reviews, photographs, comments, suggestions, questions, or other content.

You represent that content you submit:

  • Is accurate based on your genuine experience
  • Does not violate another person’s rights
  • Does not contain unlawful, defamatory, threatening, or abusive material
  • Does not contain malicious software or harmful code
  • Does not disclose private information without authorization
  • Does not contain misleading advertising, spam, or fraudulent claims

You retain ownership of content you submit.

By submitting content for publication, you grant Sketchora a non-exclusive, worldwide, royalty-free, transferable, and sublicensable license to use, reproduce, adapt, publish, translate, display, and distribute that content in connection with operating, promoting, and improving Sketchora.

This license lasts only for as long as reasonably necessary for those purposes, subject to applicable law.

You may contact us to request removal of submitted content. Removal may not always eliminate copies already used in lawful records, completed marketing materials, backups, or third-party reposts.

SECTION 27 – REVIEW MODERATION

We may moderate, reject, restrict, or remove submitted content for lawful reasons, including content that:

  • Is unrelated to the product or service
  • Contains personal information
  • Uses abusive or discriminatory language
  • Appears fraudulent
  • Contains undisclosed advertising
  • Violates intellectual property rights
  • Includes malicious links
  • Violates these Terms

We will not knowingly alter a review in a way that materially misrepresents the reviewer’s opinion.

Moderation does not mean that Sketchora endorses or verifies every statement made by a reviewer.

SECTION 28 – FEEDBACK AND SUGGESTIONS

Ideas, suggestions, or feedback voluntarily submitted to Sketchora may be used to improve our products, services, website, or operations.

Unless otherwise agreed in writing, submitting general feedback does not create:

  • A confidentiality obligation
  • An employment relationship
  • A partnership
  • A payment obligation
  • Ownership rights in a general idea

This section does not apply to information protected by our Privacy Policy or another written confidentiality agreement.

SECTION 29 – THIRD-PARTY TOOLS AND SERVICES

The website may use or provide access to services supplied by third parties, including:

  • Payment processors
  • Shipping carriers
  • Analytics providers
  • Customer-support platforms
  • Review systems
  • Social media services
  • Advertising platforms
  • Website applications

Third-party services may be governed by their own terms and privacy policies.

We do not control every aspect of an independent third party’s systems, availability, security, or conduct.

Your use of an optional third-party service may be subject to the agreement between you and that provider.

Nothing in this section removes responsibility that applicable law places directly on Sketchora.

SECTION 30 – THIRD-PARTY LINKS

The website may contain links to external websites for convenience or informational purposes.

A link does not necessarily constitute an endorsement, approval, partnership, or guarantee.

We are not responsible for the content, availability, security, or practices of an independent website that we do not operate, except where applicable law provides otherwise.

Before completing a transaction or providing personal information to a third party, review that third party’s terms and privacy practices.

SECTION 31 – PRIVACY

Our collection, use, retention, and disclosure of personal information are described in our Privacy Policy.

By using the website, you acknowledge that information may be handled as described in the Privacy Policy and in accordance with applicable law.

Payment providers, carriers, fraud-prevention services, fulfillment providers, and other service providers may receive information reasonably necessary to perform services connected with your order.

SECTION 32 – ELECTRONIC COMMUNICATIONS

By using the website or contacting us electronically, you consent to receive order-related communications electronically where permitted by law.

These communications may include:

  • Order confirmations
  • Payment notices
  • Shipping updates
  • Tracking information
  • Address verification requests
  • Delay notices
  • Refund confirmations
  • Policy notices
  • Customer-support responses

You are responsible for maintaining an active email address and reviewing your spam or junk folder.

Marketing communications will be handled according to applicable consent requirements and our Privacy Policy.

You may unsubscribe from promotional emails using the method provided in the communication, but you may continue receiving non-promotional messages related to an active order or account.

SECTION 33 – PROHIBITED USES

You may not use the website:

  • For an unlawful or fraudulent purpose
  • To infringe intellectual property rights
  • To harass, threaten, abuse, or discriminate
  • To submit false customer or payment information
  • To distribute viruses, malware, or harmful code
  • To interfere with website security or operation
  • To gain unauthorized access to accounts or systems
  • To scrape data in violation of law or our rights
  • To impersonate another person or organization
  • To manipulate reviews or promotions
  • To test stolen or unauthorized payment information
  • To conceal fraudulent transaction activity
  • To place orders prohibited by applicable trade restrictions
  • To interfere with another person’s use of the website

We may investigate suspected misuse and preserve or disclose relevant information when reasonably necessary to protect rights, prevent fraud, comply with law, or respond to lawful legal process.

SECTION 34 – EXPORT, IMPORT, AND TRADE RESTRICTIONS

Products may be subject to export, import, transportation, sanctions, or trade restrictions.

You agree not to purchase, export, re-export, transfer, or use a product in violation of applicable law.

We may refuse, hold, or cancel an order when:

  • The destination is restricted
  • The customer or transaction is subject to sanctions
  • The carrier cannot lawfully transport the product
  • Required documentation cannot be obtained
  • The product is prohibited at the destination

When an order is lawfully canceled before shipment, we will provide an appropriate refund for the canceled merchandise.

SECTION 35 – ERRORS, OMISSIONS, AND CORRECTIONS

Information on the website may occasionally contain errors, inaccuracies, or omissions relating to:

  • Product descriptions
  • Prices
  • Promotions
  • Shipping charges
  • Delivery estimates
  • Product availability
  • Specifications

We may correct such information and update the website at any time.

Corrections will not be used to impose a higher charge on an accepted order without customer authorization.

Material errors affecting an order will be handled reasonably and in accordance with applicable law.

SECTION 36 – MODIFICATIONS TO THE WEBSITE

We may modify, suspend, restrict, or discontinue all or part of the website.

We may also change:

  • Website features
  • Product selections
  • Account functions
  • Payment options
  • Shipping options
  • Promotions

Where reasonably possible, we will avoid making changes that improperly interfere with an already accepted order.

We are not liable merely because a website feature is changed or discontinued, except where liability cannot lawfully be excluded or the change breaches an existing obligation.

SECTION 37 – WEBSITE AVAILABILITY

We do not guarantee that the website will always be available, uninterrupted, secure, or error-free.

Temporary interruptions may occur because of:

  • Maintenance
  • Updates
  • Hosting failures
  • Network failures
  • Security incidents
  • Third-party service interruptions
  • Events outside our reasonable control

We will make reasonable efforts to restore service where appropriate.

A temporary website interruption does not cancel an order that has already been validly accepted.

SECTION 38 – DISCLAIMER OF WARRANTIES

To the maximum extent permitted by applicable law, the website and its general informational content are provided on an “as available” and “as is” basis.

We do not warrant that:

  • Website access will always be uninterrupted
  • Every technical error will be corrected immediately
  • Every item will remain available
  • Every delivery estimate will be achieved
  • The website will meet every user’s individual requirements

Product warranties, if any, may be provided by the manufacturer or stated on the product page.

Nothing in these Terms excludes:

  • An express written warranty provided by Sketchora
  • A manufacturer warranty that legally applies
  • Statutory guarantees
  • Implied warranties that cannot lawfully be disclaimed
  • Remedies for a defective, unsafe, or materially misdescribed product

SECTION 39 – LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Sketchora and STOREVIA LIMITED will not be liable for indirect, incidental, special, consequential, exemplary, or punitive losses arising solely from use of the website or purchase of a product.

This may include loss of profit, opportunity, data, goodwill, or business interruption where such loss was not reasonably foreseeable or where liability may lawfully be limited.

To the maximum extent permitted by applicable law, our total liability arising from a particular order will generally not exceed the amount paid to Sketchora for the product or order giving rise to the claim.

These limitations do not apply where liability cannot legally be excluded or limited, including where applicable law provides otherwise for:

  • Fraud
  • Intentional misconduct
  • Gross negligence
  • Death or personal injury
  • Defective or unsafe products
  • Breach of non-waivable consumer rights
  • Violation of a statutory obligation

The limitations in this section apply only to the extent they are lawful and enforceable in the applicable jurisdiction.

SECTION 40 – CUSTOMER RESPONSIBILITY FOR LOSS

You may be responsible for loss, damage, claims, or costs resulting from your own:

  • Unlawful conduct
  • Fraud
  • Deliberate misuse of the website
  • Unauthorized use of another person’s payment method
  • Infringement of third-party rights
  • Failure to follow product warnings
  • Material breach of these Terms

You will not be responsible for loss caused by Sketchora, a defective product, a security failure for which you are not responsible, or another matter that applicable law places on us.

SECTION 41 – INDEMNIFICATION

To the extent permitted by applicable law, you agree to indemnify and hold harmless STOREVIA LIMITED, Sketchora, and their officers, employees, contractors, and service providers from third-party claims arising directly from:

  • Your unlawful use of the website
  • Your intentional violation of these Terms
  • Your infringement of a third party’s rights
  • Fraudulent or unauthorized activity carried out by you
  • Your unlawful modification, resale, or misuse of a product

This obligation does not apply to the extent that a claim was caused by Sketchora’s own breach, negligence, unlawful conduct, defective product, or another matter for which liability cannot lawfully be excluded.

SECTION 42 – FORCE MAJEURE

Neither party will be responsible for delay or failure caused by an event outside that party’s reasonable control, except for payment obligations already due and rights that cannot legally be excluded.

Such events may include:

  • Natural disasters
  • Severe weather
  • Fire or flood
  • War or civil disturbance
  • Government action
  • Border closure
  • Public health emergencies
  • Carrier interruption
  • Labor disruption
  • Transportation failure
  • Power or telecommunications outage
  • Supplier failure that could not reasonably have been prevented

The affected party must make reasonable efforts to reduce the impact of the event.

Where an event materially delays an unshipped consumer order, cancellation, delay consent, or refund options will be provided where required by applicable law.

SECTION 43 – TERMINATION

These Terms remain effective until terminated by you or Sketchora.

You may stop using the website at any time.

We may suspend or terminate website access for a material violation of these Terms, suspected fraud, security risk, unlawful conduct, or another lawful reason.

Termination does not eliminate:

  • Payment obligations already incurred
  • Rights relating to an accepted order
  • Existing refund obligations
  • Rights or liabilities that arose before termination
  • Provisions intended by their nature to survive termination

Sections concerning intellectual property, submitted content, responsibility, liability, disputes, and governing law may survive termination where appropriate.

SECTION 44 – GOVERNING LAW

These Terms and the operation of Sketchora are governed by the laws of Hong Kong, without regard to conflict-of-law principles, except where the mandatory laws of another jurisdiction apply.

Nothing in this section deprives a consumer of protections that must apply under the laws of the consumer’s place of residence or delivery destination.

Nothing in these Terms prevents a customer from bringing a claim in a court or forum where applicable consumer law gives the customer a non-waivable right to do so.

SECTION 45 – DISPUTE RESOLUTION

Before beginning formal proceedings, we encourage you to contact us so that we have a reasonable opportunity to investigate and resolve the issue.

Please provide:

  • Your name
  • Order number
  • Contact information
  • A clear description of the issue
  • The resolution requested
  • Relevant photographs, records, or correspondence

Both parties should attempt to resolve the dispute in good faith.

If a dispute cannot be resolved informally, either party may pursue available remedies in a court or other forum with lawful jurisdiction.

These Terms do not require mandatory private arbitration and do not waive any right to participate in a class or collective proceeding where such a right exists under applicable law.

SECTION 46 – SEVERABILITY

If a court or other competent authority determines that part of these Terms is unlawful, invalid, or unenforceable, that part will be enforced to the maximum lawful extent or severed where necessary.

The remaining provisions will continue in effect unless doing so would materially defeat the purpose of the agreement or applicable law requires otherwise.

SECTION 47 – NO WAIVER

A failure or delay by Sketchora in enforcing a provision does not permanently waive that provision or any other right.

A waiver is effective only when clearly made by an authorized representative and only for the specific matter addressed.

SECTION 48 – ASSIGNMENT

You may not assign or transfer your obligations under these Terms without our prior written consent, except where applicable law permits otherwise.

We may assign or transfer our rights and obligations as part of:

  • A corporate reorganization
  • Merger
  • Acquisition
  • Sale of assets
  • Transfer of the Sketchora business
  • Appointment of a successor service provider

Any assignment will remain subject to applicable consumer rights and existing obligations.

SECTION 49 – ENTIRE AGREEMENT

These Terms and the policies incorporated into them constitute the agreement between you and Sketchora concerning use of the website and purchases made through it.

They replace prior general communications concerning the same subject matter, but do not replace:

  • An accepted order confirmation
  • A written warranty
  • A written customer-service resolution
  • A product-specific agreement
  • A right created by applicable law

Headings are provided for convenience and do not limit the meaning of a provision.

SECTION 50 – CHANGES TO THESE TERMS

We may update these Terms to reflect changes in:

  • Website operations
  • Products
  • Payment methods
  • Shipping practices
  • Security procedures
  • Legal requirements
  • Business structure

The “Last Updated” date identifies the most recent version.

Changes will apply prospectively from the effective date unless applicable law requires otherwise.

The Terms generally applicable to an order will be the version presented when that order was placed, except where a later change:

  • Is required by law
